Appointments had been made with Senator Mann (R, Senate Education Chair, Monroe), Senator Karnes (R, Senate Vice-chair, Upshur), and Senator Hall (R, Finance Chair, Putnam). See the Legislative Report below, as well as other information on meetings throughout the day. Report on Morning Meetings with Senators Hall, Karnes, and Mann: After some delays because of caucus meetings, several ACF representatives (Dennison, Shurbutt, Goldstein, and Puckett) met with Senator Hall, Chair of Finance. Hall gave his assessment of the budget situation, suggesting that the draconian budget passed by the Freedom Republicans would be vetoed by the Governor and his hope was that a less offensive budget of compromise might be passed coming from the Finance Committee. This budget would hold the line with CTC and 4-year institutions at a cut of around 2%, with Marshall and WVU receiving up to 5% cuts. Hall was well-aware of the role higher education will play in the economic come-back of West Virginia, and he reiterated that the economic situation we are in was caused by the tax cuts several years ago in conjunction with the fall of extraction revenuesa perfect storm for our crisis today. Hall said he was less in favor of so-called sin taxes; rather, he favors a school property tax (which will also impact absent landlords). Such a tax would raise some $80 million in revenue, $50 to $60 million of which would go to education. He also raised the possibility of a new casino in the southwestern part of the state that would bring in $100 to $200 million in additional revenue. Addressing the budget issue can only come through some tax rise, he said. He noted that the budget presented by the Freedom Republican majority had a number of errors in it, and he felt certain that the Governor would not sign any bill they presented, so the financial outlook looks poised for conflict. Our brief meeting with Senator Karnes involved our sharing faculty issuesa) steady stream of higher education funding and 2) support of the HEPC/CTCC and our BOGs. Karnes did not see a need for any higher education governing body beyond our BOGs, so we shared our insights concerning the steady progress the State has made with graduation rates, transfer and articulation, co-requisites addressing the developmental issue, curricular guidance, and the plethora of other services rendered through the HEPC office. Karnes response, evincing a lack of understanding of how a credible higher education system works, was that if the institutional BOGs need coordination, they could form an ad hoc committee to meet and discuss amongst themselves. Our brief discussion with Mann was more favorable, and he gave us access to him, saying that if any bills needed rewording, to please contact him and he would try to accommodate higher education faculty. Most important Senator Mann said he would try to come to the ACF retreat at Pipe Stem in July. Despite this cordial comment, it was clear that higher education issues at the moment are being driven by WVU and its team of lawyers; and HB2542 which has passed the legislature was written without any input form the HEPC or CTCC. See Bruce Walkers comments below concerning these bills. Report on meeting with Bruce Walker, Corley Dennison, and Adam Green: Bruce was asked why there were no responses to requests for changes in HB2542, a personnel bill written by WVU, and he replied that the HEPC had virtually no input in this bill and the backers were anxious to run it through as written while its momentum was high. This personnel bill is now finished and essentially makes all classified staff unclassified, according to Walker, eliminating bumping, and making lay-offs of both faculty and staff possible as administrations and BOGs see fit. Bruce also suggested that SB511, which is a governance bill, is important to watch. He noted that regarding the way the legislature works, all bills dealing with higher education will have to be reconciled when the session ends and the last bill passed holds precedent over those that were passed prior in terms of overlap. Thus any overlap and conflicts between SB511 and HB2542 will defer to SB511. We can take this to mean that if faculty wish to have input into 2542 through 511, we must coordinate with Senator Mann. Bruce continued saying that SB511 exempts WVU, Marshall and Osteopathic school from any HEPC oversight. Likewise capitol projects and certain other oversights maintained over the other schools will no longer be in place (see partial bill summary at the end of this report). March 26 is the deadline for bills to be out of committees in the house of origin, and March 29 is the deadline for considering a bill in the house of origin. April 8 is legislative adjournment. There were a number of bills that both Dr. Green and Bruce Walker were concerned about. These include the several bills regarding guns on campuses (HB 2559, 2713, and 2835), which are written so that they can preclude any campus prohibition against firearms in our classrooms and at athletic events. HB2756 will make Promise available for some certificate and associate CTC students; this expansion of Promise will cost WV an additional $17 million. HB 2825, a Sexual Harassment bill, changes the bench-mark for rape to no affirmative consent, a perplexing and undefinable definition. HB 2886 will duplicate degrees and leave in doubt qualified faculty. Finally, Bruce reported that a budget bill (see Halls comments above) would be forthcoming in a few days. HB2020, which would freeze PEIA, doesnt have much traction; this bill may be preempted by other bills affecting PEIA (SB555). Chair Goldstein said he will see if Josh Swords can give us an insiders view, perhaps at the next meeting. Additional Comments from Dr. Dennison: Chair Goldstein asked Dr. Dennison about his take on SB511 and how that might impact HB2542. This bill will primarily reorganize higher education, noted Dr. Dennison. He reiterated that Marshall, WVU, and Osteopathic institution are completely out of the system. Nothing needs to be reported from them, including data; thus there will be no repository of data for decision-making and providing direction for WV higher education. The remaining schools are semi-autonomous. Also Higher Education Resource money will be taken away; thus programs such as Great Teachers will not be supported by the HEPC. Dr. Dennison added that SB 555 to eliminate PEIA will leave each institution to negotiate independently for faculty health insurance. Finally, Dr. Dennison reported on Course Equivalencies: Algebra, Pre-calculous, chemistry, anatomy/physiology, and trigany institution can get a course on the equivalency list but must apply using the process provided. This process will be forthcoming this spring. Next on the course equivalency docket may be the social sciences, psychology, American history, and others that are part of CORE curriculum. Two English workshops for the Co-requisite initiative are planned at the location of Concord and Ogleby, with Peter Adams as the workshop facilitator; a Math workshop is planned for May 15-16, at the Charleston Embassy Suites. Algebra and quantitative reasoning will be subject of this math Co-requisite Workshop. Dr. Dennison was also asked about funding for Public Radio in this new State budget, and he replied that if the Freedom Republican budget is signed by the Governor, public radio will go dark. III. Report on Governor Justice Noon Address at MU: Marybeth Beller spoke about the Governors address at Marshallseemingly more a repeat of the State of the State address than enlightening regarding the current condition of legislative affairs. Civility Commission: Sylvia Shurbutt (), Mike Ditchen (BridgeValley), Sylvia Senften (West Liberty) will work with Casey Sack, Bruce Walker, and Dr. Dennison to craft a structure for a commission or body that will address academic bullying and administrative/department chair overreaching in the treatment of faculty. V. Great Teachers Seminar: Funding for the next Great Teachers Conference is in place, so ACF representatives are encourages to share the flier and other information with their institutions. The application due date is May 1. VI. Summer Retreat Plans: Senator Mann has agreed to come to our summer retreat at Pipe Steam.
